This Policy informs you about how we collect, use, transfer, and protect your personal data. We process this data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the General Data Protection Regulation, hereinafter “GDPR”), as well as relevant national data protection legislation.

WHO ARE WE?

Founded in 1991 by engineer Aurel Kober, KÖBER SRL is a family business and the first private company producing paints and varnishes in Romania. Currently, KÖBER SRL is the leading national supplier of paints and resins for the decorative and industrial products market in Romania. The company owns three production plants, the first one established being the factory in Turturești, Neamț County, with a production capacity of over 30,000 tons of industrial products, distributed to our customers through four divisions: Industrial Paints, Automotive Paints, Wood Protection Paints, and Powder Coatings. The second factory owned by the KÖBER group is the decorative products factory in Dumbrava Roșie, Neamț County, with a production capacity of over 100,000 tons of Decorative Paints. At the end of 2002, the company also entered the thermal power plant market under the Motan brand, being the first and only domestic producer of thermal power plants, succeeding in a market dominated by importers.

HOW DO WE PROCESS YOUR PERSONAL DATA?

As a Data Controller, the company processes the personal data of candidates applying for available positions, employees, individual customers, representatives of legal entity customers, contractual partners, collaborators, and other individuals interacting with the company and/or engaged in contractual relationships with it.

Personal data is:

  • processed lawfully, fairly, and transparently concerning the data subject;
  • collected for specified, explicit, and legitimate purposes and not further processed in a manner that is incompatible with those purposes;
  • adequate, relevant, and limited to what is necessary concerning the purposes for which they are processed;
  • accurate and, where necessary, kept up to date;
  • kept in a form that permits the identification of data subjects for no longer than is necessary for the purposes for which the personal data is processed;
  • processed in a manner that ensures appropriate security of the personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage, using appropriate technical or organizational measures.

WHAT TYPES OF PERSONAL DATA DO WE PROCESS AND FOR WHAT PURPOSES?

For the conclusion and execution of service and partnership/collaboration contracts, we primarily process the following types of personal data: name, surname, series and number of ID card/passport, gender, home/residence address, bank account number, email address, phone number.

For organizing the Köber Feedback session, we process the following data on social media platforms: images captured in photos and video materials, and voice. Additionally, to collect feedback from attendees at these events, we process the following data: name, surname, email address, county/region.

For posting on social media pages and the website, we process the following personal data: image, name, surname.

For website visitors, we may collect data through cookies or similar technologies, such as IP address, internet browser, location, web pages accessed on our website, time spent on the website, internet network, device used. We do not use your personal data to send you marketing communications, such as newsletters, unless you have expressly consented to such communications by checking a consent box. In this context, we process only your email address and ensure you have a simple option to unsubscribe at any time, i.e., to withdraw your consent regarding the receipt of such communications.

WHAT ARE THE LEGAL GROUNDS FOR PROCESSING PERSONAL DATA?

Your personal data is processed for:

  • the conclusion and execution of various contracts;
  • fulfilling our legal obligations;
  • based on consent requested and/or provided in advance (e.g., in the context of staff recruitment, for sending marketing communications, etc.);
  • the legitimate interests pursued by the company (e.g., adopting measures for the protection and security of our employees, exercising some rights and legitimate interests of the company in contentious or non-contentious proceedings, etc.).

FOR HOW LONG DO WE PROCESS YOUR PERSONAL DATA?

Personal data is stored for processing for the duration necessary to achieve the processing purposes mentioned in this Policy or for the duration imposed by law (e.g., in terms of archiving, accounting, etc.).

TO WHOM DO WE TRANSMIT PERSONAL DATA?

We will not communicate or transfer any personal data collected from or about you to any third party, except:

  • Public authorities and institutions – when there is a legal obligation to do so or for a legitimate interest (e.g., defending the company’s rights in contentious or non-contentious proceedings, etc.).
  • Contractual partners or collaborators of the company providing web hosting services, website development, website maintenance (Nastasiu Development SRL, Str. Negoiu 4, Bucharest, Sector 3, contact: team@websquad.ro), online marketing and communication services.
  • Any third party – if you have expressly and specifically consented to such communication for that particular situation and those specific data.

WHAT PROTECTION MEASURES AND GUARANTEES DO WE TAKE?

The company implements appropriate technical and organizational measures to ensure a high level of security and protection of personal data. We use security methods and technologies, together with internal policies and procedures, including control and audit procedures, to protect the personal data collected in accordance with relevant legal provisions in the field of personal data protection.

WHAT ARE YOUR RIGHTS AS A DATA SUBJECT?

Any data subject can exercise the following rights, as provided by the General Data Protection Regulation:

  • The right of access;
  • The right to rectification;
  • The right to erasure;
  • The right to restriction of processing;
  • The right to data portability;
  • The right to object to processing;
  • The right not to be subject to a decision based solely on automated processing, including profiling;
  • The right to contact the National Supervisory Authority for Personal Data Processing (www.dataprotection.ro) and the courts.
